Terms of Service

1. Who we are

Brainwash It ("we", "us") is operated from the Netherlands. Contact details will be published here before public launch.

2. These terms

These terms are an agreement between you and us — not with Apple. By creating an account or using the Brainwash It app, you agree to them. You must be at least 16 years old to use Brainwash It.

The app itself is licensed to you under Apple's Standard End User License Agreement: a personal, non-transferable license to use the app on Apple devices you own or control. You must also comply with the App Store terms and any other third-party terms that apply when using the app. Apple has no obligation to provide maintenance or support for the app, and is a third-party beneficiary of these terms with the right to enforce them against you.

If we make material changes to these terms, we will let you know in the app or by email before they take effect. If you don't agree with a change, you can stop using the service and delete your account. Continued use after the change takes effect means you accept it.

3. What Brainwash It is

Brainwash It lets you record a short sample of your voice, from which we create a synthetic copy of that voice using third-party AI providers. The app then plays affirmations back to you in that voice, with read-along text, background sounds, and an optional brainwave audio layer. You can also record affirmations directly in your own real voice.

All spoken audio produced from your voice copy is AI-generated. It is synthetic audio, not a recording of you, and it may occasionally contain mispronunciations or other errors.

We may add, change, or remove features over time, and we may apply reasonable fair-use limits to audio generation to keep the service running for everyone.

4. Your account

You sign in with your Apple account or email address. Keep your sign-in details secure — you are responsible for activity on your account. You can delete your account at any time in the app's Settings, which removes your profile and synced data. See our Privacy Policy for details on what is deleted and when.

5. Your voice

Your voice recordings and the synthetic copy made from them remain yours. You give us permission to process your recordings and generate audio with them — including through our service providers, currently Cartesia and ElevenLabs — solely to provide the service to you. We do not sell your voice, and we do not use it to impersonate you.

Our providers process your audio on our instructions as data processors, under data-processing agreements, on servers in the United States under EU-approved transfer safeguards (Standard Contractual Clauses and the EU–US Data Privacy Framework). We do not permit our providers to use your recordings or generated audio to train their AI models. Providers retain audio only as needed to provide the service, as described in our Privacy Policy.

You may only record your own voice. Recording or uploading another person's voice is not permitted, in any circumstances.

You can withdraw your permission at any time by deleting a saved voice or deleting your account. Doing so removes the associated recordings and voice copies from us and our providers, as described in our Privacy Policy.

6. Your affirmations

Affirmations you write are yours. You give us permission to process them — converting them to speech, syncing them across your devices, and storing them — solely to provide the service to you. You are responsible for what you write; don't write content that is unlawful.

When using Brainwash It, you must not:

8. Purchases and subscriptions

Some features may require a paid subscription, purchased through Apple's in-app purchase system. The price and billing period are shown before you buy. Subscriptions renew automatically until you cancel, which you can do at any time in your App Store subscription settings; cancellation takes effect at the end of the current billing period.

Because digital content is delivered immediately, you consent to immediate performance when you purchase and acknowledge that you lose the EU 14-day right of withdrawal to the extent the law allows. Refund requests for App Store purchases are handled by Apple. If we change subscription prices, we will notify you in advance, and you can cancel before the new price takes effect.

9. Health notice

Brainwash It is a wellbeing tool. It is not medical or mental-health care, and nothing in the app is medical advice, diagnosis, or treatment. It is not a substitute for care from a qualified professional. If you have a mental-health condition, consult a professional before using the app, and stop using it if it causes you distress. If you are in crisis, contact your local emergency services (112 in the EU).

The optional brainwave audio layer uses rhythmic sound. Do not use it while driving or operating machinery. If you have epilepsy or a history of seizures, use a pacemaker, or are pregnant, consult a doctor before using it.

10. Intellectual property

The app, its design, and its content (other than yours) belong to us and our licensors. Your voice, your recordings, and the affirmations you write remain yours.

11. Disclaimers and liability

We work hard to keep Brainwash It reliable, but to the extent permitted by law the service is provided "as is". Nothing in these terms limits rights you have under EU or Dutch consumer law that cannot be limited by contract, including your statutory rights regarding conformity of digital content and services.

To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amounts you paid us in the twelve months before the claim, or €50 if you have paid nothing. This limitation does not apply to damage caused by our intent or gross negligence, or to death or personal injury.

12. Termination

You can stop using Brainwash It and delete your account at any time. We may suspend or terminate your access if you materially violate these terms, giving notice where reasonably possible. Sections that by their nature should survive (including 5, 10, 11, and 13) survive termination.

13. Governing law

These terms are governed by Dutch law. If you are a consumer in the EU, this does not deprive you of the mandatory consumer protections of the country where you live, and you may bring proceedings in the courts of that country.
